3. Access data and hosting

You may visit our websites without disclosing any details about yourself. Every time you access a website, the web server merely stores a so-called logfile, which contains data such as the name of the requested file, your IP address, the date and time of access, the transmitted volume of data and the requesting provider (access data), and registers the visit.

This access data is analysed exclusively for the purpose of safeguarding a trouble-free operation of the site and to improve our service. This serves to safeguard our predominantly legitimate interests within the framework of a balancing of interests in displaying our offer correctly pursuant to point (f) of Art. 6(1) GDPR. All access data is deleted seven days after your visit to the site at the latest.

Third-party hosting services

A third-party provider processing data on our behalf provides us with the services of hosting and displaying the websites. Any data collected during the use of these websites or in the forms provided for this purpose in the online shop as described below will be processed on third-party servers. Processing on other servers only takes place as described here.

Our service provider is located within a country of the European Union or the European Economic Area.

 

4. Data collection and use for contacting you and creating a customer account

We collect personal data, which you voluntarily provide to us when contacting us (e.g. by contact form or email) or when creating a customer account. Mandatory fields are identified as such, because we need this information for processing your contact request or creating your customer account. The respective input form indicates what data is collected. We utilise the data you disclose to us pursuant to point (b) of Art. 6(1) GDPR in order to process your requests. If you have given your consent in accordance with point (a) of Art. 6(1) GDPR by deciding to create a customer account, we will use your data for the purpose of creating a customer account. As a registered user, additional services are available to you by way of your customer account. The data provided by you will then be used for the processing of these services. After deletion of your customer account, and at the conclusion of any fiscal and commercial retention periods, we restrict further processing of your data and erase your data unless you have explicitly consented to further use of your data or if we reserve the right to the extent permitted by law to continue using your data, about which we inform you in this Statement. You may delete your customer account at any time. Either send a message to the contact details specified above under section 1 or use a dedicated function in your customer account.

 

5. Online request for availability of eyewear models

You may check the availability of eyewear models with our partner opticians online through us. We collect the following data and information about you: Name, email address, telephone number, requested product and partner optician. Data is collected based on your consent pursuant to point (a) of Art. 6(1) GDPR in order to process your request, to inform you of the availability following the request from the optician and to send you messages in connection with your request. None of your personal data will be transmitted to our partner opticians.

 

6. Email newsletter

If you subscribe to our newsletter, we will use the data required for this purpose or provided separately by you in order to send you our email newsletter regularly based on your consent pursuant to point (a) of Art. 6(1) GDPR.

You may unsubscribe from our newsletter at any time. Either send a message to the contact details specified above under section 1 or use a dedicated unsubscribe link in the newsletter. After unsubscribing, we erase your email address and the information provided voluntarily by you from the list of recipients, unless you have explicitly consented to further use of your data or if we reserve the right to the extent permitted by law to continue using your data, about which we inform you in this Statement.

The newsletter is distributed via “MailChimp”, a newsletter distribution platform of the US-based Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.

For the distribution of the newsletters, your email address will be stored on MailChimp’s servers in the USA.

MailChimp uses this information to distribute and evaluate newsletters on our behalf. Furthermore, according to its own information MailChimp may use this data to optimise or improve its own services, e.g. for the technical optimisation of the distribution and display of the newsletters, or for economic purposes to determine the countries of origin of the recipients. However, MailChimp does not use the data of our newsletter recipients to contact them or to transmit the data to third parties.

MailChimp is obliged to adhere to the EU-US Privacy Shield Framework for the collection, use and storage of personal data from the EU. Rocket Science Group LLC (MailChimp) has declared by certification that it complies with the Privacy Shield principles. Furthermore, we have concluded a data processing agreement with MailChimp, in which MailChimp undertakes to protect the data of our users and to process the data exclusively in accordance with the data protection regulations on our behalf and in accordance with our instructions. Statistical information and analyses

The newsletters contain a so-called “web beacon”, i.e. a pixel-sized file that is retrieved from the MailChimp server when the newsletter is opened. During this retrieval, technical information is initially collected such as information about your browser and your system, as well as your IP address and time of retrieval. This information is used for the technical improvement of the services based on technical data or target groups and their reading habits on the basis of their retrieval locations (determined through the IP address) or access times.

Statistical information also includes information about whether newsletters are opened, when they are opened and which links are clicked. These evaluations help us to identify the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.

 

7. Cookies and web analyses

To make the visit to our website more attractive and to enable certain features, to display suitable products, or for market research, we apply so-called cookies on various pages. Google Tag Manager

We use Google Tag Manager on our website. Google Tag Manager is a service of Google Ireland Limited, a company incorporated and operated under Irish law with registered office at Gordon House, Barrow Street, Dublin 4, Ireland (www.google.de).

Google Tag Manager helps us to embed various codes and services into our website in an organised and simplified way. Google Tag Manager implements the tags or triggers the embedded tags. Google Analytics Remarketing

We integrate Google Remarketing on this website, a service of Google Ireland Limited, a company incorporated and operated under Irish law with registered office at Gordon House, Barrow Street, Dublin 4, Ireland (www.google.de).Google Remarketing is a Google AdWords feature that enables companies to display advertisements to internet users who have previously visited these companies’ websites. The integration of Google Remarketing therefore allows a company to create user-relevant advertisements and consequently to display advertisements of interest to the internet user.

The purpose of Google Remarketing is to display advertisements that are relevant to your interests. Google Remarketing helps us to display advertisements through the Google advertising network or on other websites that are tailored to the individual needs and interests of internet users.

Google Remarketing sets a cookie in your system. Setting the cookie enables Google to recognize visitors to our website who subsequently visit websites that are also members of the Google advertising network. Every time you visit a website in which the Google Remarketing service is embedded, your internet browser automatically identifies itself to Google. Facebook Pixel, custom audiences

On our website we use the so-called “Facebook Pixel”, a service of Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA (“Facebook”). This operation is used to evaluate the effectiveness of Facebook advertisements for statistical and market research purposes and can help to optimise future advertising measures. The data collected is anonymous to us and does not provide us with any information about the identity of the user. 8. Advertisements

Google Ads Remarketing

We advertise this website in the Google search results as well as on third-party websites through Google Ads. When you visit our website, the so-called remarketing cookie is set by Google, which automatically enables interest-relevant advertising by means of a pseudonymised cookie ID and on the basis of the pages you visit. This serves to safeguard our predominantly legitimate interests within the framework of a balancing of interests in marketing our website in an optimal manner pursuant to point (f) of Art. 6(1) GDPR. After the purpose ceases to exist, and at the end of our use of Google Ads Remarketing the data collected for these purposes will be deleted.

Any further processing will only take place if you have consented to Google linking your web and app browser history to your Google account and using information from your Google account to personalise advertisements you see on the web. If in this case you are logged in to Google during your visit of our website, Google will use your information in conjunction with Google Analytics data to create and define target audience lists for cross-device remarketing purposes. Google Adwords conversion tracking

To compile statistics about the use of our website and to analyse the data in order to optimise our website for you, we also use Google Conversion Tracking, a service of Google Ireland Limited, a company incorporated and operated under Irish law with registered office at Gordon House, Barrow Street, Dublin 4, Ireland (www.google.de).

Google Adwords places a cookie on your computer, if you reached our website through a Google advertisement. These cookies become invalid after 30 days and do not serve the purpose of personal identification. If the user visits certain pages of the website of Adwords customers and if the cookie has not expired yet, Google and the customer may recognise that the user has clicked on the advertisement and was forwarded to this page. Every Adwords customer receives a different cookie. It is thus impossible to track cookies through the websites of Adwords customers. The information obtained using the conversion cookie is used to compile conversion statistics for Adwords customers who have opted for conversion tracking.

The processing is carried out on the basis of point (f) of Art. 6(1) GDPR out of the legitimate interest in the analysis of the effectiveness and efficiency of our website. In this respect, Adwords customers receive information on the total number of users who clicked on their advertisement and have been forwarded to a website with a conversion tracking tag. They do not, however, receive any information which can be used for the personal identification of users.

This allows us to display interactive maps, such as the Shopfinder, directly on the website, offering you a comfortable use of the website. Our online presence on Facebook, YouTube, Instagram, Xing, LinkedIn

Our presence in social networks and on platforms serves to offer improved, active communication with our customers and interested parties. There, we inform you of our products and regular promotions.

When you visit our online presences in social media, your data may be collected and stored automatically for market surveys and advertising purposes. Using pseudonyms, so-called usage profiles are generated from this data. This may be used to place advertisements inside and outside the platforms which are assumed to correspond to your interests. To this end, cookies are implemented on your terminal device. These cookies store customer habits and interests. This serves to safeguard our predominantly legitimate interests within the framework of a balancing of interests in marketing our offer in an optimal manner and communicating effectively with our customers and interested parties pursuant to point (f) of Art. 6(1) GDPR. 12. Retention period of personal data

The requirement of the storage duration of personal data is specified in the respective legal retention period. After expiry of this period, the corresponding data will be routinely deleted as far as they are no longer required for the performance or initiation of a contract.

 

Right to object

Insofar as we process personal data to safeguard our predominantly legitimate interests within the framework of a balancing of interests as mentioned above, you may revoke this processing with effect for the future. If the processing takes place for the purpose of direct marketing, you may exercise this right at any time in the manner explained above.
